Premise

The following text governs the terms and conditions of sale for the products marketed by Madam srls (the "Products"). All contracts for the sale of products by Madam srls to third parties (the "Customers") are governed by these General Conditions, which form an integral and substantial part of every proposal, order, and order confirmation for the purchase of the products. The sales conditions applicable to the order are those in effect on the date of the order itself. Any modification regarding operations or payment terms that may be granted as an exception to the General Conditions will only be valid if Madam srls has accepted such condition in writing.

The General Conditions apply to all Customers, except for some provisions applicable exclusively to Consumer Customers (a "Consumer Customer" is defined as a natural person who purchases products for purposes unrelated to any entrepreneurial or professional activity carried out); it is assumed that a Customer who submits a purchase proposal by entering their VAT number in the customer’s personal data area is not a "Consumer Customer." Purchase Contracts concluded by Consumer Customers are also subject to Articles 50 to 63 of Legislative Decree No. 206/2005. Madam srls may modify, at any time and without notice, the content of the General Conditions in this document: such changes will be effective from the date of publication on the Website.

PURCHASE PROCEDURE

The order submitted by the Customer constitutes a contractual proposal and implies full knowledge and complete acceptance of these General Conditions.
The correct receipt of the Customer's proposal is confirmed by Madam srls through an automatic response sent to the Customer's email address. This automatic email only confirms the correct receipt of the proposal. The confirmation message will indicate the 'Order Number,' to be used in any subsequent communication with Madam srls.
Each order is visible to the Customer in their personal area on the Website. Once the order has been processed, the data in the personal area will be updated accordingly. Each Purchase Contract concluded between Madam srls and the Customer is considered finalized upon acceptance of the order by Madam srls. Madam srls has the right to accept or reject, at its sole discretion, the order submitted by the Customer, without the latter being able to make any claims or rights of any kind, including compensation, in case of non-acceptance of the order. The order is considered accepted by Madam srls if, within 2 working days from the submission of the order, the Customer does not receive any further communication. In case of non-acceptance, Madam srls will notify the Customer via email.
By submitting the order, the Customer declares to have read all the information provided during the purchase procedure and to fully accept the General Conditions and payment terms described below.

PRODUCT PRICES - DELIVERY COSTS - PRODUCT AVAILABILITY

All product prices are clearly indicated on the Website and include VAT. They do not include any other taxes, duties, or fees imposed by the applicable regulations in case of importation. In such cases, the Customer must clear the products through customs and pay the applicable duties and taxes (other than VAT) in the country of importation.
The prices and availability of products listed on the Website are subject to change at any time without notice. However, for orders in the process of being accepted or already accepted by Madam srls, the sales conditions in effect at the time of order submission will apply.
The availability indicated in product descriptions is not updated in real-time; in the event of multiple accesses to the site, the actual availability of individual products may significantly change within the same day compared to the information shown on the Website. Due to these variables, Madam srls does not guarantee the immediate shipment of purchased products listed as available on the Website and shall not be held responsible for any delivery delays.
For payments by bank transfer, Madam srls will ship the products only when the corresponding amount has been credited to the bank account registered in the name of Madam srls.
If the delivery times of the ordered product are delayed compared to those indicated on the Website before the order, Madam srls commits to promptly informing the Customer via email. Until the moment of shipment, the Customer has the right to cancel or modify the order, exclusively following the procedures indicated in their personal area. The cost of each shipment, which may vary depending on the delivery and payment method, as well as the destination country and the total order amount, is added to the total purchase price and is clearly indicated and communicated to the Customer before finalizing the Purchase Contract within the Website.
The visual representation of products on the Website, where available, typically corresponds to the photographic image of the products and is solely intended to present them for sale, without any guarantee or commitment by Madam srls regarding the exact correspondence of the image on the Website with the actual product (particularly concerning actual size and/or color aspects of the products).
Shipping costs are always the responsibility of the Customer and are calculated and indicated during the order completion process.

RETURNS

For "Consumer Customers" within the European Union, the consumer rights regulations apply, and therefore, if the customer is not satisfied with their purchase, the unused item(s) may be returned for a store credit or refund within 14 days from the date of order receipt.
The shipping costs for returned items are the responsibility of the customer.
Note: Customers purchasing with a VAT number are not entitled to exercise the right of withdrawal. For orders with destinations outside the EU, the right of withdrawal does not apply.
To initiate a return, a request must be sent via email to info@ruemadam.it, indicating the reference order number and the items from that order to be returned. Madam srls will provide the necessary instructions for completing the return process.
The right of withdrawal is forfeited in the following cases:
- Partial use of the item and/or damage to the product due to causes other than transport;
- Missing or damaged original packaging of the item(s);
- Absence of integral elements of the product.
In the above cases, Madam srls will return the purchased item to the sender, charging them for the shipping costs.
For hygienic reasons, the right of withdrawal cannot be exercised if the product is used, the seals have been removed or the pump of the spray bottles has been activated. The product must be returned in its original packaging (including the box), complete in all its parts, in perfect condition, accompanied by the purchase receipt and carefully packaged by the customer.

COMPETENT COURT

The Purchase Contract between the Customer and Madam srls is considered concluded in Italy and is governed by Italian law. Any disputes shall be subject to the jurisdiction of the Court of Verona.
